It is a strict liability system – which means it does not matter if your employer was negligent or not — you can still be covered by Worker’s Compensation insurance. It is like no fault car insurance. Worker’s compensation is typically the only remedy a worker has when injured on the job. In exchange for coverage that is paid for by the employer, workers are not allowed to sue their employers beyond the coverage of Worker’s Compensation. This is called the “compensation bargain.” Worker’s Compensation can cover medical expenses (including mileage for medical appointments), lost wages, and disability benefits.
